The latest in a series of drug lawsuits to resolve the massive online theft of prescription drugs from a large U. S. pharmacy chain. In April, the Federal Trade Commission (FTC) and U. Attorney’s Office filed a new class-action lawsuit against the online pharmacy chain, including its generic versions of Viagra, Cialis and Levitra, which has generated hundreds of millions of dollars in sales for Pfizer, the maker of the drug.
The FTC and U. Attorney’s Office are seeking $1.9 million in damages for the company, claiming it engaged in anticompetitive practices that violate the Federal Trade Commission’s patent rights and is unfair competition. The suit seeks a share of the total $2.1 million in punitive damages, plus an additional $5 million in damages for alleged violation of the Act of Reorganization Act.
The plaintiffs alleged that the company knew that the drugs it distributed were counterfeit and sold them for less than the price that the manufacturer charged for their generic versions of the drugs. The alleged anticompetitive conduct was done in an effort to maintain the integrity of the FDA’s safety standards.
The suit was filed on behalf of the plaintiffs in a suit filed in the United States District Court for the Eastern District of Virginia. The suit alleges that the company did not adequately communicate its anticompetitive behavior, failed to adequately disclose the risks of the counterfeit drugs, and failed to warn the consumers of the dangers of the drugs. “[T]he generic drug companies’ conduct does little more than encourage the introduction of counterfeit and ineffective medications to the marketplace,” said Michael Segal, Chief of the Food and Drug Administration’s Center for Drug Evaluation and Research. “We have seen a rise in online pharmacies selling drugs that are not FDA-approved, or that are not approved by the FDA.”
The complaint is not limited to the case filed in federal court in the Eastern District of Virginia, and the company has agreed to settle all of its claims.
“The FDA’s approval of a generic version of Cialis and Levitra to treat erectile dysfunction is a major victory for the industry,” said Joseph Lechleiter, FDA Director. “The lawsuit provides a clear example of the government’s disregard for the safety and efficacy of generic drugs, and the actions of the generic manufacturers.”
In November, the FDA announced that it would not approve Cialis for use by patients with pulmonary hypertension, a condition in which the heart is unable to pump enough blood into the lungs to supply essential oxygen and essential fluids. Cialis is a prescription drug that is prescribed to men with pulmonary hypertension. It is the most prescribed medication for erectile dysfunction. “The manufacturer did not adequately communicate the risks and benefits of Cialis in its advertisements,” the company wrote. “This conduct was done in an effort to maintain the integrity of the FDA’s safety standards.”
The lawsuit alleged that the company marketed the drug without the knowledge of patients who could not take the drug, and that Pfizer failed to inform patients about the risks and benefits of the drug.
